Samsung Galaxy Tab not cool, judge rules

Samsung has finally tasted a success in its ongoing battle with Apple over alleged patent infringements with the Galaxy Tab. But that taste is bittersweet with the ruling partially decided by the idea that the Tab isn’t as
“cool” as the iPad.



Apple has been taking court action around the world ever since the first version of the Samsung tablet arrived. It’s not only claiming Samsung ripped off the iPad design, but effectively claimed that it has the exclusive rights to tablets that are black, flat, rectangular with round corners, and without “substantial adornment” on the bezels.


The initial victory went to Apple, at least in the United States. While the court has yet to rule on the merits of the case, it did grant a temporary sales ban on the Galaxy Tab 10.1 (which has been superseded by a new edition), noting that it appeared to be “virtually indistinguishable” from the iPad in terms of look.

For the sales ban to go ahead, Apple had to deposit $2.6 million with the court. If the court later finds in favor of Samsung and thus retroactively decides the sales ban was wrong, this money will go to Samsung as compensation.

In the United Kingdom however, Samsung scored a win this week, with a judge tossing the claim completely. Judge Colin Birss said that although there were visual similarities, there was no serious chance of people confusing the two devices.

Had Birss stopped there, it would have been party time for Samsung. Unfortunately he explained his decision in further detail that will have made for painful ruling:

“[The Samsung devices] do not have the same understated and extreme simplicity which is possessed by the Apple design. They are not as cool. The overall impression produced is different.”
