Apple & Samsung battle spills outside courtroom

Most trials involve lawyers arguing about the evidence they present in court. But the Apple-Samsung battle has now turned into a dispute about what Samsung said outside the court buildings.

The two sides are currently battling it out to settle several patent claims, most notably Apple’s accusation that Samsung copied its designs for smartphones and tablets. It’s become one of the relatively rare cases when such a dispute gets as far as a full-blown jury trial.


Earlier this week, Judge Lucy Koh ordered that Samsung be barred from bringing up two sets of evidence in the case because they’d been submitted too late for Apple to have a fair chance to prepare a response.

The two sets of evidence concerned — which had already featured in media reports –could be quite significant. The first is claimed to show that one of the handsets cited in the case, the Samsung F700, was first designed in 2006 before the release of the iPhone, which would appear to rule out it being a copy.

The second set of evidence is claimed to show that in fact Apple copied elements of the iPhone from Sony, which would make claims of Apple originality harder to stand up.

On Tuesday, Samsung put out a press statement mentioning the evidence had been thrown out, then have further detail about the evidence in response to journalist questions.

That led to Judge Koh becoming “livid” because the jury could see reports of the evidence in the media, thus undoing the effect of barring it from the case. She demanded a full explanation.

Samsung has responded with a court filing saying its actions didn’t break any court order. It says that regardless of what the jury is and isn’t allowed to see in the courtroom, there’s no reason why it shouldn’t talk to the media about arguments and evidence that had already been reported.

Apple is still demanding that Samsung be sanctioned over the media discussions. It doesn’t appear as if any such sanctions could affect the proceedings in the case itself.
